This is why if you have a radio license you need to be knowledgeable enough to check your gear yourself or pay a radio shop to test yo gear before putting it into service on ham, GMRS, commercial bands etc. With that said if you radio creates interferance and/or spurs on other bands when using it on GMRS then chances are pretty good it was doing it while using it on ham bands as well. My stance on this about using non type accepted radios on GMRS is simply this "IF you know what you are doing and are sure yor radio is not causing interference / spurs onto adjacent channels or bands that can be an issue, then there should be no problem.". Pretty sure the US government has more important things to worry about these days than a modded ham radio being used on GMRS. If you have done that, well, then you are a lawbreaker just as much and are throwing stones while sitting in a glasshouse. If you have never done that continue arguing. Now, besides the fact that it is against the rules, how exactly does that impact you if someone does not hurt you, does not transmit with too much power, or as you pointed out transmits APRS data? The short answer is: it does not and as such what is business telling other ppl what they can do or not or what they should do or not? The example with driving 36 in a 35 zone is fully applicable. And talking of capricious: there even is a legal concept that allows you to ignore rules and laws that are unjust and capricious, but of course that you will have to explain in court. You have the right to like whatever you please and other ppl have the right to ignore you or other rules they find capricious. If you read my post very carefully You will see that I agree it is not legal, yet you pointing that out what has already been pointed out 10000 times, what point exactly are you making?
